1. Acceptance of Terms

By accessing or using EMAILDelivery.SITE's services, you agree to these Terms of Use and Acceptable Use Policies. and Software As A Service Agreement.   If you do not agree, do not use our services.

  • When the term "EMAILDelivery.SITE" with any variation on capitalization is used or it also includes "EDS", "eds", our payment processor, parent company, partner, affiliates, etc.

2. Services Provided

EMAILDelivery.SITE offers a suite of email services including but not limited to email sending, receiving, and management tools. We may update, modify, or discontinue services at our discretion.



3. Account Registration and Security

  • You must provide accurate and complete information when creating an account.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

  • Notify us immediately of any unauthorized use of your account.



4. Acceptable Use

  • You agree to use EMAILDelivery.SITE only for lawful purposes and in compliance with all applicable laws and regulations.

  • Prohibited activities include but are not limited to: sending spam or unsolicited emails, engaging in phishing or fraud, and distributing malware.

  • You are responsible for the content you send through EMAILDelivery.SITE  and must ensure it does not infringe on any third-party rights.

  • You may not use information you inadvertently access that does not belong to you and you will notify us immediately of such occurrence and you will protect such data as a proprietary and confidential information.

  • You may not reverse-engineer or duplicate or attempt to subvert or compromise any of EMAILDelivery.SITE's systems or services.

7. Limitation of Liability

  • EMAILDelivery.SITE  provides its services "as is" and disclaims all warranties to the extent permitted by law.

  • We are not liable for any indirect, incidental, or consequential damages arising from the use of our services.

  • We are not liable for any damages as the result of a data breach or malfunction of our systems or services



8. Termination:  Terms of Use Violations; Effect of Termination.

  • We reserve the right to suspend or terminate your account if you violate these Terms of Use and Acceptable Use Policies or for any other reason we deem necessary, or with or without reason or cause or advance notice.

  • You may terminate your account at any time by following the instructions in your account settings or your contract or service agreement.

    • You agree that EMAILDelivery.SITE in its sole discretion for any or no reason and without penalty may terminate your access and use of our Services, the EMAILDelivery.SITE Platform or any of the other EMAILDelivery.SITE Services or any Account (or any part thereof) that you may have with EMAILDelivery.SITE and remove and discard all or any part of your Account user profile at any time. EMAILDelivery.SITE may also in its sole discretion and at any time prohibit you from accessing and using our Services, the EMAILDelivery.SITE Platform or discontinue providing access to the EMAILDelivery.SITE Platform or any of the other EMAILDelivery.SITE Services or any part thereof with or without notice. You agree that any termination of your ability to access or use our Services, the EMAILDelivery.SITE Platform or any of the other EMAILDelivery.SITE Services or any Account you may have or portion thereof may be effected without prior notice and you agree that EMAILDelivery.SITE will not be liable to you or any third party for any such termination. EMAILDelivery.SITE reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing EMAILDelivery.SITE to disclose the identity of anyone that is believed to violate these Terms. Any suspected fraudulent abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies that EMAILDelivery.SITE may have at law or in equity. As provided herein EMAILDelivery.SITE does not permit copyright infringing activities on the EMAILDelivery.SITE Platform the Site or any of the other EMAILDelivery.SITE Services and EMAILDelivery.SITE shall be permitted to terminate access to the Fundraising Services the EMAILDelivery.SITE Platform or any of the other EMAILDelivery.SITE Services. BY ACCEPTING THESE TERMS YOU WAIVE AND SHALL HOLD EMAILDELIVERY.SITE  HARMLESS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY EMAILDELIVERY.SITE DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER EMAILDELIVERY.SITE OR LAW ENFORCEMENT AUTHORITIES.

  • You.

    • Your only remedy with respect to any dissatisfaction with (i) the EMAILDelivery.SITE Platform or any of the other EMAILDelivery.SITE Services (ii) any term of these Terms or (iii) any policy or practice of EMAILDelivery.SITE in providing Services or operating the EMAILDelivery.SITE Platform or the other EMAILDelivery.SITE Services is to terminate your use of the EMAILDelivery.SITE Platform any of the other EMAILDelivery.SITE Services and your Account (if any). You may terminate your use of EMAILDelivery.SITE Services and your Account (if any) at any time.

  • Effect of Termination.

    • If your Account is terminated for any reason or no reason you agree: (a) to continue to be bound by these Terms (b) to immediately stop using the EMAILDelivery.SITE Platform and to remove all payment card logos from your website and wherever else they are displayed (c) that the Right to Use and the License shall automatically terminate (d) that we reserve the right (but have no obligation) to delete all of your information and Account data stored on our servers and (e) that we shall not be liable to you or any third party for termination of access to the EMAILDelivery.SITE Platform deletion of your information or Account data or export of your information or Account data. 

9. Disclaimer

  • Neither EMAILDelivery.SITE, any of it's partners, associates, employees or related business partners guarantee any level of performance, functionality or success.

  • All funds paid to EMAILDelivery.SITE are final and non-refundable because we have allocated equipment, services, and bandwidth for customer utilization whether customer choose to use it or not.

  • We do not guarantee that any of our code will work beyond TESTED VERSIONS of emaildelivery.com and if you upgrade and it breaks, we are not responsible.
  • We have no control over the emaildelivery.com company, partners, affiliates, retailers, resellers, consultants or employees or it's products or services and cannot be held accountable for any action, inaction or performance criteria past, present or future on their part.
  • Operational "bugs" are a fact of software development and we require you to have backups of your environment, product, etc., and in the event a bug causes loss of data, you agree that your only remedy is to restore from backup and will not hold us accountable in any way.  We do not knowingly publish software with bugs in it and do our best to provide a reliable software and service within the capabiltiies of our team and company.
